Zachary V. Moen represents classical musicians and fine arts clients, nationally and internationally, in intellectual property, contract, litigation, art law, and entertainment law matters.
Mr. Moen’s practice and experience includes:
• Representing classical music clients in connection with contract negotiation and drafting (including personal services agreements, recording agreements, management agreements, ensemble agreements, and others), music publishing, copyright and trademark issues, music license and clearance issues, royalty accountings, and litigation matters.
• Representing art clients in connection with contract negotiation and drafting (including commission agreements, consignment agreements, and purchase and sale agreements), copyright, trademark, and VARA issues, and litigation matters.
• Representing film clients in connection with rights acquisition and clearance, contract negotiation and drafting, financing issues, copyright and trademark issues, E&O insurance, and litigation matters.
• Representing authors in connection with publishing agreements, rights acquisitions and clearances, copyright and trademark issues, and litigation matters.
• Representing clients in connection with the making, acquisition, and sale of fine musical instruments, including contract negotiation and drafting (commission agreements consignment agreements, and purchase and sale agreements), customs compliance issues, Lacey Act compliance, and litigation matters.
Mr. Moen serves as an adjunct professor of law, teaching law school courses titled "Art, Cultural Heritage, and the Law" and "Entertainment Law," and is a member of the American Bar Association Sections of Intellectual Property Law and International Law, Forum Committee on Entertainment & Sports Industries, and Art & Cultural Heritage Law Committee and the Lawyers' Committee for Cultural Heritage Preservation.
In addition to his distinguished legal career, Mr. Moen has been an avid violinist since the age of three and is a professional violinmaker, having apprenticed with prominent violinmaker Gregg Alf, where he learned traditional Cremonese methods of violinmaking and maintained a widely read online blog chronicling his experiences. Through his apprenticeship, Mr. Moen constructed a replica of the 1744 Guarneri del Gesù “Ole Bull” violin which was to be displayed in Oslo, Norway in connection with violinist Ole Bull’s 150th birthday. Mr. Moen also attended the violin making and acoustics workshops sponsored by the Violin Society of America at the Oberlin College Conservatory of Music. Mr. Moen’s instruments are available for trial and purchase through Alf Studios.
Prior to founding Moen & Case LLP, Mr. Moen was an attorney at Jenner & Block LLP, one of the country’s top law firms. After relocating to the Detroit area, Mr. Moen joined Butzel Long, P.C., where he represented corporate and entertainment clients in intellectual property matters.
Mr. Moen graduated magna cum laude from Loyola University Chicago School of Law, where he ranked in the top five students in his class during all six semesters, was elected managing editor of the law review, and was a member of a state championship moot court team. Mr. Moen completed his undergraduate studies at Wheaton College in Massachusetts, where he was awarded the Nancy P. Norton Prize in History and American Studies for his honors thesis titled "Famous for Fifteen Minutes: Andy Warhol's Influence on the Culture of Celebrity."
Mr. Moen is admitted to the bars of Illinois, the District of Columbia, and Michigan as well as the U.S. District Courts for the Northern District of Illinois and the Eastern and Western Districts of Michigan. Mr. Moen is an experienced mediator, having completed the mediation training program approved by the Michigan State Court Administrative Office.
